Regulations on the provision of services for the production and processing of photographs

These rules establish the procedure for providing photo processing services, hereinafter referred to as the Executor.

The purpose of these rules is to optimise the work process and ensure high quality of services provided.

1. Client’s appearance in the photo:

1.1 The client should provide from 6 to 10 photos as originals, which can be taken on a smartphone or camera.

To process the photos, the Executor needs a demonstration of the client’s face from different angles, taken not later than 6 months before placing the order, as well as the indication of its basic parameters – gender, type of face, race, age, build. This condition is mandatory. In this case, all parameters of the photos will be correct and the result will be satisfactory.

2 Provision of services:

2.1 The Executor shall provide services for the production of photographs on digital media.

2.2 The photographs produced are artistic works intended for private use by the Client and under no circumstances may be used as photographs for official documents. The transfer of the photos produced by the Executor by the Client to the state services for official documents will be the Client’s responsibility. It may violate the legislation of the Republic of Poland and other countries in terms of inadmissibility of interference in the correction of facial features during the correction.

2.3 The Executor shall provide photo editing services in accordance with the technical capabilities of the available computer equipment, software and artificial intelligence tools.

Additional corrections in the graphic editor are made by agreement for an additional fee, within the framework of the current legislation (interference with facial features, changing eye colour, etc. is not allowed).

2.4 Photos are enhanced automatically using neural network: dodge & burn, eye brilliance, mattifier, skin tone, heal, scripts: tanning, removing redness, adding volume.

Additional correction: removing imperfections that the neural network could not cope with – colds, large pimples and boils, softening nasolabial folds, lifting hair volume, etc. are done in graphic editors.

2.6 The client’s likeness in the photos is corrected to the extent possible, but the result depends largely on the original photos provided. If the quality of the original photos does not allow the neural network to get a complete representation of the client’s facial features, it is accepted that the client may become unlikeable in parts of the photos. Therefore, the client should take a certain amount of responsibility in selecting the original photos. This is especially important as the Executor’s operator cannot know the client personally and gets an idea of the client only from the photos provided.

2.7 Claims regarding the quality of the work performed may only relate to obvious defects in the photos. The customer cannot refuse delivery of the work for subjective reasons – for example, if in his/her opinion the subject is not suitable for the outfit, because of differences in hairstyles, body composition, or if he/she thinks that in some pictures he/she does not look like himself/herself, etc.

2.7 Each processing of the photo package is charged separately. It is possible to process individual images in photo editors to eliminate minor defects. These works are performed on the terms of additional payment.

2.8 The client has no right to violate the technological process of the Executor’s work, to demand additional services over and above those established by these Rules, to prevent other clients from receiving services.

2.9 The Executor sends the photos to the Client’s e-mail or via WeTransfer service as a digital archive file.

3. GPDR / RODO

3.1 The Executor guarantees the conformity of the service to the requirements of GPDR/RODO and confidentiality of the provided images.

3.2 Whilst all our images are close to reality, we use blurred neutral backgrounds that are not identifiable. We do not create or adjust images for erotica or pornography, violence, prohibited acts, or for use as documents. All orders containing such assignments will be rejected without explanation.

3.2 Any dissemination of customer information as well as posting of images on the Internet without the written consent of the owner is prohibited.

3.2 The Executor sends the result of the work to the customer by e-mail, after which the work is considered completed. The Executor is not obliged to keep the client’s images for a long time.

4 Responsibilities of the parties:

4.1 The client is responsible for the quality of the images provided.

4.2 The Executor is responsible for the quality of services rendered in accordance with these rules, technical capabilities of the equipment specified in the technical documentation of the company-manufacturer of the equipment and consumables.

5. Other terms and conditions:

5.1 These rules may be changed unilaterally by the Executor.

5.2 In case of disputes, the parties undertake to resolve them through negotiations or in accordance with the current legislation in accordance with the established procedure.

5.3 In case of demanding a refund for poorly executed work on photo processing, the customer is obliged to provide an appropriate act stating the reasons for refusal.
